{"id":2218,"date":"2011-07-03T05:35:57","date_gmt":"2011-07-03T12:35:57","guid":{"rendered":"http:\/\/www.lichtermanlaw.com\/?p=2218"},"modified":"2011-08-22T12:44:32","modified_gmt":"2011-08-22T19:44:32","slug":"estate-tax-estate","status":"publish","type":"post","link":"https:\/\/www.lichtermanlaw.com\/index.php\/estate-tax-estate\/","title":{"rendered":"What&#8217;s Included In Your Estate Tax Estate?"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In <\/span><a href=\"http:\/\/www.lichtermanlaw.com\/index.php\/what-is-a-michigan-estate\/\" target=\"_blank\"><span style=\"color: #800000;\">last week&#8217;s post<\/span><\/a><span style=\"color: #000000;\">, we took a look at what an &#8220;estate&#8221; is here in Michigan.\u00a0 Guess what?\u00a0 That&#8217;s not the only &#8220;estate&#8221; you need to consider when working with a <\/span><a href=\"http:\/\/www.lichtermanlaw.com\/index.php\/firm-overview\/how-were-different\/\" target=\"_blank\"><span style=\"color: #800000;\">Grand Rapids, MI estate planning attorney<\/span><\/a><span style=\"color: #000000;\"> (or going through the probate process . . . yuck!).\u00a0 You also need to consider your federal estate tax estate. No, that doesn&#8217;t necessarily mean that you will have to pay estate taxes, but you do have to add things up to find out if estate tax is due.\u00a0 To do that, you need to know what is included when adding up those numbers.\u00a0 I guarantee you there will be at least a few surprises.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The easiest way is to think about everything you own . . . <em>everything<\/em>!\u00a0 Real estate, bank accounts (including some or all of jointly held accounts), retirement accounts, brokerage accounts, automobiles, collectibles, business interests, and life insurance, just to name a few.\u00a0 Did you catch that last one?\u00a0 It is a surprise to many people that life insurance they own is included in determining the size of their estate tax &#8220;estate.&#8221;\u00a0 I regularly hear, &#8220;but I was told life insurance is not taxed!&#8221;\u00a0 Well, yes, it is not <em>income<\/em> taxed and it may not cause any estate tax (depending on the size of your &#8220;estate&#8221;), but it <em>is<\/em> included in determining how big your estate tax &#8220;estate&#8221; is and whether any estate taxes are due.\u00a0 You can read my previous post about how to avoid that by <a href=\"http:\/\/www.lichtermanlaw.com\/index.php\/protecting-cash-value-life-insurance\/\" target=\"_blank\">clicking here<\/a>.<br \/>\n<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">We&#8217;re not done yet!\u00a0 Here&#8217;s another big surprise to many people . . . your estate tax &#8220;estate&#8221; even includes some things you gave away!\u00a0 Yes, you read that right.\u00a0 A couple of common examples are gifts made within 3 years of death and property that you gave away but in which you retained an &#8220;interest.&#8221;\u00a0 The definition of &#8220;interest&#8221; for these purposes is too in depth for this post, but it is roughly (very roughly) the same as keeping a &#8220;benefit&#8221; of what you gave away (e.g. the right to say who gets it, the right to receive payments, etc.).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">A little bit surprised by all that&#8217;s included?\u00a0 Most people are.\u00a0 Here&#8217;s the thing about probate (your Michigan estate) and estate taxes (your estate tax estate) . . . they are voluntary!\u00a0 The only people who have deal with them (or whose loved ones have to deal with them) are those who don&#8217;t plan to avoid them.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">So you can see that we all have an estate and in many cases it is bigger than we thought.\u00a0 Knowing that, why wouldn&#8217;t you <a href=\"http:\/\/www.lichtermanlaw.com\/index.php\/contact-us\/\" target=\"_blank\">call us at 616-827-7596 <\/a>to have your say in how your &#8220;estate&#8221;
