{"id":3043,"date":"2012-06-03T13:18:30","date_gmt":"2012-06-03T20:18:30","guid":{"rendered":"http:\/\/www.lichtermanlaw.com\/?p=3043"},"modified":"2012-06-03T13:18:30","modified_gmt":"2012-06-03T20:18:30","slug":"privacy-in-your-estate-plan","status":"publish","type":"post","link":"https:\/\/www.lichtermanlaw.com\/index.php\/privacy-in-your-estate-plan\/","title":{"rendered":"Maintaining Your Privacy in Your Estate Plan"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #000000;\">It seems like our personal information is becoming easier and easier to acquire these days, and a recent conversation really brought it to light. \u00a0Because many of my clients have become great friends, I have a game I&#8217;ll play with them. \u00a0Many will notice my middle initial and ask what my middle name is. \u00a0It&#8217;s not that my middle name is horrible or anything, but it is rare, and I&#8217;m not terribly fond of it (although I&#8217;m sure I&#8217;ll get over that). \u00a0So, I make them a deal. \u00a0If they can guess my middle name, I&#8217;ll let them know if they are correct. \u00a0None have figured it out . . .<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">. . . until a month or so ago. \u00a0One of my more tech &#8220;savvy&#8221; clients emailed me with his guess and he was right on. \u00a0I have to admit, after so many not guessing it correctly, I was curious how he found out. \u00a0Turns out he used google and some public information sites on the web and was not only able to tell me my middle name, but also how old I am, where I live and where I used to live. \u00a0Being tech &#8220;savvy&#8221; myself, I was quite impressed because I do what I can to not have my private information public.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">And I think it brought home a key point in estate planning. \u00a0Many families end up in probate court after someone passes away, either as a result of having <em>no<\/em>\u00a0estate plan or having a will-based estate plan. \u00a0If you thought you would avoid probate by having a will, read <a href=\"http:\/\/www.lichtermanlaw.com\/?p=1984\" target=\"_blank\">this previous post to find out the truth<\/a>. \u00a0Now, I&#8217;m not here to malign probate and to say it is some evil, horrible process. \u00a0But, <a href=\"http:\/\/www.lichtermanlaw.com\/?p=978\" target=\"_blank\">it is certainly a public process<\/a>, as your will and what you owned is part of the probate court file that anyone can access. \u00a0I&#8217;ve even seen some wills with social security numbers in them. \u00a0Some may say, &#8220;big deal, I&#8217;m dead so my social security number doesn&#8217;t matter.&#8221; \u00a0Well, I beg to differ &#8211; <a href=\"http:\/\/www.huffingtonpost.com\/2012\/04\/24\/identity-theft-dead-people_n_1449217.html\" target=\"_blank\">read this recent news story if you don&#8217;t think it can still be used<\/a>\u00a0and cause problems.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">So, it&#8217;s probably no surprise that many of my clients want to maintain as much of their privacy as possible &#8211;
