{"id":3299,"date":"2013-01-20T14:31:11","date_gmt":"2013-01-20T21:31:11","guid":{"rendered":"http:\/\/www.lichtermanlaw.com\/?p=3299"},"modified":"2013-01-21T06:55:10","modified_gmt":"2013-01-21T13:55:10","slug":"provisions-of-2013-tax-law","status":"publish","type":"post","link":"https:\/\/www.lichtermanlaw.com\/index.php\/provisions-of-2013-tax-law\/","title":{"rendered":"Estate and Gift Tax Provisions of New Tax Law"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Well, as most Americans know by now, the Congress passed new tax legislation on January 2, 2013, to keep us from going over the &#8220;fiscal cliff.&#8221; \u00a0Oh, wait . . . I guess they didn&#8217;t keep us from going over the &#8220;cliff.&#8221; \u00a0We actually did, but then they &#8220;fixed&#8221; it. \u00a0Politics aside, the short version is that we have new tax legislation. \u00a0And, I think it&#8217;s very important for families and individuals to know about how the new tax legislation affects the estate tax, gift tax, and charitable planning areas. \u00a0I won&#8217;t go over the income tax side of things in this post, because those are the provisions that are most talked about in the media outlets.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">So, here are some of the key points of the tax legislation as it relates to estate tax, gift tax, and charitable planning:<\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">As I mention in <span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/?p=3281\" target=\"_blank\"><span style=\"color: #800000;\">this previous post<\/span><\/a><\/span>, they reinstated the ability for certain individuals to make a direct transfer to a charity from their IRA. \u00a0And, they even gave a limited time window (until January 31, 2013) to make the direct transfer and have it count for the 2012 tax year. \u00a0That pretty nice! \u00a0Read my previous post to find out the qualifying details.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">The Federal gift and estate tax exemption (and generation skipping transfer tax exemption) will remain at $5,000,000, indexed for inflation. \u00a0The inflation adjustment puts the exemption amount at roughly $5,250,000 for 2013. \u00a0There are two key things to point out on this: (1) this means that most families and individuals will\u00a0<em>not<\/em> have to pay any estate tax when they pass away (a good thing!), and (2) the opportunity to transfer a large amount of assets (e.g. small business interests and other rapidly appreciating assets) remains (this is a\u00a0<em>very<\/em> good thing).<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">The tax rates on estates over the exemption amount is raised from 35% to 40%.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">The &#8220;portability&#8221; provisions remain. \u00a0Basically, this\u00a0allows the unused exemption of the first spouse to die to transfer to the surviving spouse without having to set up trust planning specifically for this purpose. \u00a0<em>BUT, and this is a BIG but, most of the articles you will read or news shows you will watch will act like this is an automatic thing. \u00a0As in, Bob passed away and only used up $2,000,000 of his exemption amount, so Mary will &#8220;automatically&#8221; have her $5,000,000 plus Bob&#8217;s left over $3,000,000. \u00a0NO &#8211; that is not how it works. \u00a0You have to &#8220;affirmatively elect&#8221; portability after the death of the first spouse, and you must do so on a timely filed estate tax return (e.g. you must act fast!). \u00a0Please spread the word on this! With so much misinformation out there, I foresee a LOT of families losing their portability opportunities. \u00a0And, even with portability, there are myriad reasons to have a comprehensive and caring estate plan.<\/em><\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">Unrelated to the new law, but interesting to note, the amount an individual can gift on an annual basis free of estate tax is increased to $14,000 for 2013.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">So, overall, I think the new tax law is a good thing. \u00a0And, according to the law itself, it is &#8220;permanent.&#8221; \u00a0Obviously, in Washington DC, &#8220;permanent&#8221; just means that it will stay this way until they decide to change it, but it&#8217;s still better than the constantly changing world we&#8217;ve been living in for over a decade.<\/span><\/p>\n<p><span style=\"color: #000000;\">Honestly, I&#8217;m really happy to see that most families and individuals won&#8217;t have to worry about estate taxes. \u00a0Why? \u00a0Because, although many families and individuals will think it doesn&#8217;t mean they need to do estate planning, those who do planning will focus on what&#8217;s truly important about planning &#8211; creating a legacy based on who they are and what&#8217;s important to them (e.g., passing on their <span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/index.php\/estate-planning\/whole-family-wealth\/\" target=\"_blank\"><span style=\"color: #800000;\">Whole Family Wealth<\/span><\/a><\/span>).<\/span><\/p>\n<p><span style=\"color: #000000;\">And as a reminder, here just some examples of the &#8220;peace of mind&#8221; items that can be accomplished with a caring, comprehensive estate plan:<\/span><\/p>\n<ul>\n<li><span style=\"line-height: 12.997159004211426px; color: #000000;\"><span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/?p=978\" target=\"_blank\"><span style=\"color: #800000;\">Avoid probate<\/span><\/a><\/span> and the public record that goes along with it;<\/span><\/li>\n<li><span style=\"color: #000000;\">Ensure your assets are distributed to who you want, in the way you want;<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/?p=1730\" target=\"_blank\"><span style=\"color: #800000;\">Protect an inheritance<\/span><\/a><\/span> from irresponsible spending, a child\u2019s creditors, and from being part of a child\u2019s divorce proceedings;<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/?p=256\" target=\"_blank\"><span style=\"color: #800000;\">Name guardians for minor children<\/span><\/a><\/span> and provide them with <span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/index.php\/estate-planning\/childrens-protection-planning\/\" target=\"_blank\"><span style=\"color: #800000;\">guidance on how you would raise your children<\/span><\/a><\/span>;<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/?p=1498\" target=\"_blank\"><span style=\"color: #800000;\">Provide for a loved one with special needs<\/span><\/a><\/span>, without losing any valuable government benefits they may be receiving;<\/span><\/li>\n<li><span style=\"color: #000000;\">Ensure that control of your assets remains in the hands of someone you trust; and<\/span><\/li>\n<li><span style=\"color: #000000;\">Protect yourself and your family <span style=\"color: #800000;\"><a href=\"http:\/\/www.lichtermanlaw.com\/?p=3092\" target=\"_blank\"><span style=\"color: #800000;\">during a time of incapacity<\/span><\/a><\/span>.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Why wouldn&#8217;t you take this opportunity to create your legacy and make sure your family is taken care of?
